1. Agreement to Terms

By accessing or using the TankMon platform (“Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

TankMon provides a cloud-based water tank monitoring platform that collects data from IoT sensors, displays water level information, sends alerts, and facilitates service requests with local suppliers. The Service includes web-based dashboards, alert notifications, and related tools.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate and complete registration information and keep it updated.

4. Subscriptions and Billing

Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. All plans include a 30-day free trial for new accounts.

We reserve the right to change pricing with 30 days' notice. Price changes will not affect the current billing period.

5. IoT Hardware and Sensors

Sensors and LoRaWAN gateways are provided separately and may be purchased or leased. TankMon is not responsible for sensor hardware failures, installation issues, or connectivity problems caused by environmental factors. Sensor data accuracy depends on correct installation and calibration.

6. Service Marketplace

TankMon facilitates connections between property owners and service suppliers (e.g., water delivery). TankMon is not a party to any agreement between you and a supplier and is not responsible for the quality, safety, or legality of services provided by third-party suppliers.

7. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to any part of the Service; (c) interfere with or disrupt the Service; (d) reverse engineer or decompile any part of the Service; or (e) use the Service to transmit harmful code or content.

8. Limitation of Liability

To the maximum extent permitted by Australian law, TankMon shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. TankMon is not liable for water shortages, tank failures, or any damage resulting from delayed or missed alerts.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described in the Privacy Policy.

10. Termination

We may terminate or suspend your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

11. Governing Law

These Terms are governed by the laws of the State of Queensland, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
